H1B Visa suspends

The H-1B is a visa in the United States under the Immigration and Nationality Act, section 101(a)(H) that allows U.S. employers to temporarily employ foreign workers in specialty occupations. A specialty occupation requires the application of specialized knowledge and a bachelor’s degree or the equivalent of work experience. The duration of stay is three years, extendable to six years; after which the visa holder may need to reapply. Laws limit the number of H-1B visas that are issued each year: 180,440 new and initial H-1B visas were issued in 2017. Employers must generally withhold Social Security and Medicare taxes from the wages paid to employees in H-1B status.

The H-1B visa has its roots in the H1 visa of the Immigration and Nationality Act of 1952; the split between H-1A (for nurses) and H-1B was created by the Immigration Act of 1990. 65,000 H-1B visas were made available each fiscal year, out of which employers could apply through Labor Condition Applications. Additional modifications to H1-B rules were made by legislation in 1998, 2000, in 2003 for Singapore and Chile, in the H-1B Visa Reform Act of 2004, 2008, and 2009. United States Citizenship and Immigration Services has modified the rules in the years since then.

The Indian information technology (IT) services industry is likely to feel the heat if the Donald Trump administration decides to go ahead with suspension of employment visas, including the coveted H-1B visa.

The proposed suspension could bar any new H-1B holder outside America from coming to work until the suspension is lifted, though visa holders already in the country are unlikely to be affected, a Wall Street Journal report said.

Indian IT companies widely use H-1B visas to transfer highly-skilled workers to the US. India has been the only country that takes 70% of the 85,000 H-1B visas applied annually, according to market reports. The news about visa suspension comes at a time when the US visa rejection rates for Indian IT companies have been on an upswing, rising 24% in 2019, up from just 6% in 2015.

The Trump administration may soon propose another set of immigration restrictions, this time on H-1B visas for foreign-born scientists and engineers. Some observers view these public displays of limiting immigration as an effort to deflect criticism of the administration’s handling of the coronavirus pandemic. Before enacting new measures, analysts recommend the administration take into account the restrictions on H-1Bs already in current law, including the low annual limit for new H-1B petitions, and the high denial rates imposed by U.S. Citizenship and Immigration Services (USCIS). The latest data show H-1B denial rates are at record levels.

The H-1B Program

Jobs that suit the H1B visa typically need a university degree or equivalent (which can mean 3 years’ work experience for each year that would normally be spent at university). The position should be one that would normally require that level of experience.

Any H1B application must be sponsored by a valid company. So the individual must have an offer of work, education, or internship prior to submitting the application.

Important Dates for H1B Registration Process:

  • February 24th, 10 AM, EST, 2020: Employers can create H1B registrant accounts
  • March 1st, Noon EST, 2020 : Employer can start to submit H1B Registrations
  • March 20th , Noon EST, 2020: H1B Registration period ends.
  • March 31st, 2020: H1B Lottery/ Selection Results Deadline (can come before).
  • April 1st, 2020: USCIS accepts H1B petition with LCA, full info for FY 2021
  • June 30th, 2020: 90 Days deadline ends for filing of H1B petitions for FY 2021

The portal for employers or H1B registrants to start submitting their H1B registrations for their employees or applicants starting from March 1st, 2020 and it will be open until March 20th, 2020.  It will be open until noon on March 20th EST.  You cannot submit H1B registrations before March 1st, you can only create the registrant account.

The H1B Visa Cap

USCIS normally issue a maximum of 65,000 regular H1B visas each year, with some exceptions:

  1. The first 20,000 visas awarded to people who hold master’s degrees or higher do not count against the limit.
  2. Visas for people entering the US to work in higher education or in affiliated research/non-profit organizations may also be exempt from the cap.
  3. 6800 visas are normally reserved for citizens of Chile and Singapore, under the special H1-B1 visa. This number is deducted from the total (65,000 regular plus 20,000 masters’) visa allocation.

Because of the strict limits, H-1B visas are granted on a lottery basis. This means there is no guarantee that, even if you qualify, you will be awarded your visa. (Of course, if you do not apply, you cannot win the lottery.)

    • Have completed a bachelors degree or higher in the field of the specialty occupation from an accredited university.
    • Hold a foreign degree which is equivalent to a bachelors degree or higher in the field of the specialty occupation.
    • Hold an unrestricted state license registration or certification in the field of the specialty occupation in the intended state of employment.
    • Have verifiable and recognized education, experience, or training in the specialty that is equivalent to the completion of a bachelors degree or higher.
